Planning Board Meeting Minutes
June 12, 2007
Memorial Town Hall

Members Present:        C. Stanovich, R. Ricker, O. Lies, C. Prager, W. Ritter, D. Lindberg

7:30 PM the Planning Board meeting was called to order.

Continuation: 7:30 PM PUBLIC HEARING Special Permit - Holden Hills: The applicant approached the mortgage holder with a draft of a Conservation Restriction which the bank initially denied.  The applicant submitted a letter of withdrawal then further discussed acceptable restrictions with the bank who seems inclined to accept a CR.  The applicant is in the process of preparing a draft for town review.  A revised plan was not received and the applicant was requested to provide written documentation from the mortgage holder showing intention of accepting the CR.

Attorney for the applicant addressed the Board regarding issuing a Special Permit subject to approval of a conservation restriction being in place.  Certificates of occupancy will be held until the approval by the State for the special permit, is recorded with conditions.

Board Comments:

W. Ritter: Concerns with time frame.  P. Harding stated that Town's legal council needs more time to review.

C. Prager: Agreed to wait until the next meeting.

C. Stanovich: Proper legal review is recommended.

O. Lies: Brought up recreational use of the golf course as a cross country track for the public off season.

R. Ricker: The attorneys should work out the legal language.

Karl Makela, 60 Newell Rd: Spoke to Town Manager about cross country skiing.

R. Ricker: Inquired about lighting.  Pam will speak to Mike Flagg about the lighting issues.

Anthony Costello, 121 Whitney St: Issues regarding enforcing conservation restrictions.

C. Prager motioned to continue the public hearing to June 26, 2007, with a written request for an extension by the applicant, and extension for filing with the clerk on June 28, 2007.  R. Ricker seconded.  All in favor.

Village at Westminster, Newell Road: Update on the culvert on Newell Rd.  Materials ordered by DPW.  Director asked to wait until school was out so they can close the road for a couple of days.  Grading and stumping is going on now.  Applicant stated completion by July 31st.  The Board discussed the progress and paving schedule.  D. Lindberg asked why the culvert wasn't ordered long ago.  The applicant stated that it was a special order, DPW had a hard time locating it.  P. Harding will again update the Board on June 26th.

Burial of Stumps -  This is an existing DEP regulation which has been recently prohibited under 310 CMR 16.05 which requires Wood Waste (definition including tree stumps) to only be disposed of at a site approved facility.  Exemptions exist for agricultural land or existing single family residences.  No Town action is necessary.  Further, this is a Board of Health issue for enforcement.  C. Prager commented on the burial of stumps on Malden St. lots.

Zoning Board of Appeals Special Permit - 959 Wachusett Street - Stevens: The applicant is applying for a Special Permit for the operation of a fruit stand.  This is not an agricultural site.  C. Prager motioned for no planning significance.  W. Ritter seconded.  All in favor.

CMRPC Technical Assistance: As a follow up to information from the last meeting, technical assistance is available through Chapter 43D expedited permitting regulation.  Once communities adopt 43D, $150,000 is available through a grant process with EOED.  O. Lies suggested the Board look into 43D.  This should be addressed by the Master Plan Committee.  Tabled to July agenda.

Master Plan Implementation - A Board/Committee meeting was held to discuss the draft of the Master Plan Implementation Section.  The Master Plan Committee has requested that each Board provide any comments they may have by July 5, 2007.  C. Prager recommended the Board read over and come back with comments before June 25, 2007.  The Master Plan is still flagged as 'in litigation'.

Winterberry Hollow - P. Harding received the letter from the Applicant's attorney requesting a meeting with the Planning Board to discuss the letter written to the ZBA regarding the proposed 40B.. W. Ritter explained the process.

Wagner Meadows:  The plans were designed with retention basins not detention basins.  The applicant would like to raise the bottom elevation to change the ponds to detention basins.  Plans will be worked out for the changes to the bottom elevation.

Other Business:

Holden Hills Cupola: O. Lies still waiting on answer on the height issue.
